0 Supreme Court: Section 124A of Sedition banned, no new case will be registered

The Supreme Court, while giving an important decision on Wednesday, put a stay on Section 124A of the Sedition Act. All pending cases filed under it have also been stayed by the top court.

The court has directed the central government to reconsider the law. It has been clearly said that no new case will be registered under this section and under this the people in jail will be able to seek bail from the court.

The top court, while allowing the Center and the states to revise section 124A of IPC, said that when this work is not completed, no new case should be filed under this section.

Earlier, the petitions challenging the sedition law were also heard on Wednesday. Solicitor General Tushar Mehta appeared for the Centre. Presenting his arguments, he said that it would not be right to stop the registration of a cognizable offence.

However, there should be a responsible officer to investigate such cases and there should be a judicial review of his satisfaction with the case.

He told the apex court that as far as pending cases of sedition are concerned, the gravity of each case is different. Some case may have terrorist connection and some may have money laundering connection.

Ultimately the pending cases are sub-judice before the courts and we must trust the court. It was clearly stated by the Central Government that it would be unfair to pass any order prohibiting the provisions of sedition. These have been upheld by the Constitution Bench.

In fact, Section 124A of IPC, which makes sedition or sedition a crime, many petitions have been filed in the Supreme Court regarding its misuse. Union Law Minister Kiren Rijiju had said last day that following instructions from Prime Minister Narendra Modi, the ministry has decided to consider and examine the provisions of this law. The government has filed its affidavit in the Supreme Court.

Between 2014 and 2019, 326 cases of sedition were registered:

Between 2014 and 2019, a total of 326 cases were registered under this controversial law in the country. Of these, only six were convicted. According to the data of the Union Home Ministry, out of the total 326 cases, 54 cases were registered in Assam. However, between 2014 and 2019, not a single case was convicted.
