The Supreme Court has approved the grant of OBC reservation in Panchayat elections and urban body elections. Along with this, instructions have been given to the government to make reservation in seven days. It was also said that the total reservation in the state should not be more than 50%.
Earlier on May 10, the Supreme Court had directed to conduct elections without OBC reservation on the basis of the incomplete report of the triple test. After this, the government had filed a revision petition on the decision of the Supreme Court.
Madhya Pradesh Urban Development Minister Bhupendra Singh said that the hearing has just been held in the Hon’ble Supreme Court. The government has got a huge success in the order given by the Supreme Court. The Supreme Court has accepted the demand for holding elections on the basis of delimitation of 2022.
The demand for OBC reservation has also been accepted. The Supreme Court has said that OBC reservations should be made within a week. This is a big victory for our government. In Maharashtra also Panchayat elections could not be held with OBC reservation and we have got this success. Bhupendra Singh credited this to Chief Minister Shivraj Singh Chouhan.
In fact, after the order of May 10, the Chief Minister had intensified efforts to file an amendment petition, canceling the foreign trip. In this regard, he himself went to Delhi and consulted senior lawyers. Earlier on Tuesday, the Supreme Court had sought some information from the state government on the amendment petition, on the basis of which the government placed the body-wise information of the OBC population in Madhya Pradesh before the court.
Will get reservation like this:
The Supreme Court clearly said that in any case the reservation should not exceed 50%. If we look at the state wise, Scheduled Caste (SC) category is getting 16% reservation and Scheduled Tribe (ST) 20% reservation in the state.
In this way, the benefit of 36% reservation is being given. According to the order of the Supreme Court, there will be no more than 50 percent reservation. So, (50-36=14) OBC will not get more than 14 percent reservation.
However, Congress leader Syed Jaffer, who challenged the state government’s decision to conduct panchayat elections without delimitation, said in the Supreme Court that this would not happen now. Reservation will be decided according to the Janpad Panchayat.
According to this, if in a Janpad Panchayat the population of Scheduled Tribes is 30% and that of Scheduled Castes is 25%, then OBCs will not get any reservation. At the same time, if in a Janpad Panchayat the population of Scheduled Tribes is 30% and that of Scheduled Castes is 15%, then OBCs will get 5% reservation.
On the other hand, if the population of Scheduled Tribes and Scheduled Castes in the Janpad Panchayat is 5-5%. That is, OBC population is 40%, then in such a situation OBC category will not get more than 35% reservation.
Politics was happening after the order of the court:
After the Supreme Court order to hold elections without reservation, both BJP and Congress started accusing each other of ending OBC reservation. Both the political parties had announced to give 27 percent tickets to OBC leaders to cater to the OBC category if elections were held without reservation.
At the same time, after the order of the Supreme Court, the State Election Commission had intensified the preparations for conducting the elections. The commission has announced to conduct both the elections in the month of June. It has been said to issue notification of elections by May 24. However, now the experts say that according to the Janpad Panchayat, the elections may take some time to prepare for the reservation.
