The Varanasi Gyanvapi case has reached the Supreme Court. The petition has sought a stay on the order of the Varanasi Court. The petition has been filed by the Management Committee of Anjuman-e-Intejamiya Masjid, Varanasi.
The petitioner’s lawyer Huzefa Ahmadi called it against the Places of Worship Act and demanded an immediate hearing from the Supreme Court. On this, the Chief Justice said that he cannot give any order immediately. A decision on the hearing will be taken only after seeing the file.
Ahmadi, counsel for the petitioner, said, “We have filed the petition regarding the survey which has been directed to be carried out in respect of the property located in Varanasi. It (Gyanvapi) is a mosque since ancient times and it (survey) is expressly prohibited under the Places of Worship Act.
To this the Chief Justice said, ‘I have no knowledge. How can I pass such an order? I will read. Let me think.’
Get the survey done as soon as possible by opening or breaking the lock: Varanasi Court
On Thursday, the Varanasi court has accepted the application for videography and survey till the basement of the premises. While fixing the personal responsibility of the Commissioner of Police and District Magistrate, the court has ordered that the survey process of the entire premises should be completed by opening or breaking the lock.
The court has also made a strong comment on the administration and asked why the administration does not understand clear language? After completing the survey proceedings, the date of 17 May has been fixed for submission of the report and next hearing.
The court has said in the order that the district administration should take strict legal action by registering an FIR in case of any obstruction in the commission proceedings. Along with this, the DGP and the Chief Secretary have been directed to monitor the entire matter and ensure that the District Magistrate and the Commissioner of Police should not be negligent in this matter. A letter will also be sent to both.
Advocate commissioner will not be removed:
Rejecting the demand for removal of Advocate Commissioner Ajay Kumar Mishra, the court has ordered that the survey proceedings will not stop at any cost. Ajay Pratap Singh and Vishal Singh have been posted as Special Survey Advocates for their cooperation, while ordering Advocate Commissioner Ajay Mishra to continue the further survey. In the absence of any of these lawyers, the work will not stop. The survey proceedings will now be held every day from 8 am to 12 noon.
This is the whole matter:
On behalf of the plaintiff, an appeal was made to give a clear order to inspect the basement including the basement inside the barricading of the Gyanvapi Mosque. At the same time, the respondent Anjuman Inazaniya Masajid had sought replacement of Advocate Commissioner.
On April 8, on the suit filed by five women demanding daily darshan worship of Shringar Gauri, the court appointed Ajay Kumar Mishra as advocate commissioner and ordered a survey of the Gyanvapi premises and submit the report in the court by May 10. . The commission proceedings started on May 6 but could not be completed.
On May 7, the Anjuman Inazaniya Masajid Committee filed an application in the court demanding change of Advocate Commissioner. The hearing on this application was going on in the court for three days. After the decision, now the commission proceedings are expected to start soon.
